DUI patrols will be increased this weekend because of the Fourth of July holiday. Project Know ran a study calculating DUI arrests in Colorado. Colorado ranks third among the states for the number of annual DUI arrests, behind only North and South Dakota. In particular, Denver has a large number of DUI arrests.
Westword recently ran an article about the 10 Denver neighborhoods with the highest number of DUI arrests. Some of those neighborhoods or areas include Union Station, the Highlands, Capitol Hill and Montbello, but topping the list was Stapleton. From January 2012 through October 2014, there were 83 arrests. In general, DUI arrests account for a significant number of arrests as compared to other types of charges. Theft and drug possession were the only types of cases that resulted in more arrests as of 2013.
Even though the drunk driving laws are statewide laws, each jurisdiction is a little different. For example, in Denver, all arraignments are held in Courtroom 4A before the case is sent to a trial courtroom. In contrast, in Arapahoe County, cases are immediately assigned to a trial courtroom. Another example – judges in Denver, Arapahoe and Douglas will accept stipulated plea bargains, which means the defense and the prosecution may agree as to the charge being pled to as well as the sentence to be imposed. In contrast, in Jefferson and Adams counties, the judges will not accept stipulations, but will ask for the prosecution’s recommendation for sentencing, but it is up to the judge to decide the sentence. The defense and prosecution may only agree to the charge the defendant is pleading guilty to.
