Following DUI Arrest, Harbaugh Expects Smith to Play

Aldon Smith, San Francisco 49ers pro-bowl linebacker, was arrested on Friday for suspicion of DUI.  The San Jose police arrested Smith following a single car accident.  The DUI arrest happened at 7 a.m.  There were skid marks on scene and damage to a tree.  The reporting party said Smith appeared to be asleep.  Smith took a breathalyzer with a preliminary blood alcohol result of 0.150.

Officers also found marijuana in the car.  Smith did not have a prescription for the marijuana.  Based on NFL rules, Smith is not allowed to have marijuana regardless.

Fortunately, no one was injured.  It is not believed that Smith had any passengers.

This is not the first time Smith has had legal troubles.  Following his rookie season, Smith was arrested for suspicion of DUI in Miami.  Eventually, that case was pled down to reckless driving.  In 2012, Smith was stabbed during a fight at a party and in September, he was the passenger in a roll over accident.

49ers coach, Jim Harbaugh, expects Smith to play Sunday despite the DUI and possession of marijuana charges.  The 49ers play at home against the Indianapolis Colts.
