No Drinking for Dina Lohan Following DUI Arrest

Dina Lohan, Lindsay Lohan’s mom, was arrested last week for a DUI.  Lohan was driving on Long Island with a BAC of 0.20.  Lohan celebrated her 51st birthday on Sunday with her family, but without alcohol.

Perhaps Lohan has made a concious decision not to drink, or perhaps her sobriety has been court ordered, or maybe it’s both.  It is not at all unusual for a judge to prohibit people who have been charged with a DUI or DWAI from consuming alcohol while their case is pending.  It is also fairly common for judges to ensure people are following this order by requiring monitored sobriety.  Additionally, it is generally a condition of DUI and DWAI probation that the person abstain from alcohol while on probation.

If the court orders monitored sobriety as a condition of a DUI summons or bond or if a probation officer requires monitored sobriety as a condition of probation, non-compliance can have serious consequences.  Non-compliance can result in a request for a warrant, which can result in jail time.  That said, the devices that are used to monitor sobriety are not always completely accurate.  In addition, monitored sobriety can be expensive.  If you find yourself in a difficult situation related to the monitored sobriety requirements of your DUI case, an attorney may be able to help.
