Court This Week

Do you know the difference between Municipal Court and State Court?  The most important difference is the level of offense handled in each court.  Municipal courts handle municipal or city law violations, whereas state courts handle state law violations.  State law violations are generally considered more serious.  State law violations are misdemeanors and felonies.

There are also important procedural differences.  One of the more significant differences is the right for a jury trial.  In municipal court, you must specifically request a jury trial, request a specific number of jurors and pay a jury fee within a certain number of days after pleading not guilty.  If you fail to do so, you lose your right to a jury trial.  If you lose the right to a jury trial, you may still have a court trial (trial to the judge).
